Under 107.39, a small unmanned aircraft may be operated over a human being only if the person is
- A.aware of the flight and has verbally consented
- B.directly participating in the operation, or protected under a covered structure or inside a stationary vehicle, or the operation meets a Subpart D category
- C.wearing a hard hat and high-visibility vest
B. directly participating in the operation, or protected under a covered structure or inside a stationary vehicle, or the operation meets a Subpart D category
Why
Section 107.39 sets three routes: the person is directly participating in the operation, the person is located under a covered structure or inside a stationary vehicle that provides reasonable protection, or the flight complies with one of the Subpart D operational categories. Consent or protective clothing alone does not satisfy the rule.
